Terms of Service: The Contract Between Us and You

The booking contract in plain English, including what we promise, what we ask of you, and what happens when something goes wrong on either side.

These terms form the contract between you and Leonida Tours when you book. They are written to be readable, and if anything here is unclear, ask us before you book and we will explain it.

Your booking

A booking is confirmed when we send you a confirmation with the date, the time and your exact pickup point. Until that confirmation arrives, the reservation is provisional. Where a tour has limited seats, we hold a seat for 24 hours while payment is completed.

You are responsible for the accuracy of the information you give us at booking. In particular, tell us about mobility requirements, dietary needs, allergies, medical conditions relevant to the activity, the ages of children, and anything that affects your safety on the tour. We cannot reserve the right to provide an activity you have told us would be unsafe for you.

Your responsibilities

  • Arrive at the meeting point at the stated time, and tell us if you are running late.
  • Follow the guide's safety instructions at all times, including on the boat and in the Everglades.
  • Do not bring alcohol onto any vehicle or vessel.
  • Treat other guests and our staff with respect. We reserve the right to refuse service to anyone behaving in a way that endangers the group or the tour.
  • Tell us before the tour if you are pregnant, have a medical condition that affects the activity, or need medication on a long trip.

Our responsibilities

  • Run the tour as described on the page you booked.
  • Provide a licensed, insured vehicle or vessel and a trained guide.
  • Tell you as soon as we know about anything that changes the tour, including weather cancellations.
  • Tell you about a material change to the itinerary before you arrive, and offer a refund if the change makes the tour materially different from what you booked.

Changes and cancellations

Your rights to cancel and reschedule are set out in our cancellation policy, which forms part of these terms. In summary: free cancellation up to 24 hours before departure, free rescheduling subject to availability, and a full refund if we cancel for any reason.

Liability

We are responsible for the reasonable care of our guests while on our tours, and we are insured for passenger liability, property damage and medical expenses. We are not liable for events outside our reasonable control, including weather, government action, closure of the park or the port, or traffic delays that cause you to miss a third-party booking you made separately.

We are not liable for losses that arise from your own decisions, such as leaving a marked trail, ignoring a safety instruction, or choosing to be in a place we have explicitly told you is not part of the tour.

Nothing here limits your statutory rights

Nothing in these terms limits your rights under the consumer law of the country you are travelling in, including any right to a refund for a service that is not provided as described. Where a term here conflicts with your statutory rights, your statutory rights prevail.

Accessibility

We run a minibus with a ramp and can carry two wheelchairs on the city tour. The Everglades van tour is the most accessible of the day trips. Some activities, including the airboat ride and boarding via a floating dock, are not suitable for everyone, and we would rather tell you that in advance than on the day.

If you have an access requirement, message us before booking and we will tell you honestly which tours suit it. We will never book you onto an activity we think is unsafe for you.

Governing law

These terms are governed by the laws of the State of Florida and the United States, and the courts of Miami-Dade County, Florida have jurisdiction, without affecting any mandatory consumer protection you have where you live.

Changes to these terms

We may update these terms, and the date at the top of this page shows when that last happened. Terms that apply to your booking are the ones in force when you made it, so a change after you book will not affect your booking.

Frequently asked questions

When is my booking confirmed?

When we send you the confirmation email with the date, time and meeting point. Seats on limited-capacity tours are held for 24 hours while payment is completed.

Can Leonida Tours refuse to run a tour for me?

Yes, if we have been told, or we can see, that the activity would be unsafe for you, or if you behave in a way that endangers the group. We would always rather refund than run a tour badly.

What if the tour is different from what I booked?

We tell you before you arrive about any material change, and we offer a refund if the change makes the tour materially different from what you booked.

What law governs my tour?

The laws of the State of Florida, with the courts of Miami-Dade County having jurisdiction, without affecting any mandatory consumer protection you have where you live.

Can I get a refund if I do not get what I booked?

Yes. If a tour is not provided as described, you have the right to a refund under the consumer law of the country you are travelling in, and that right takes priority over anything written here.
